01 Stamp duty

What are the statutory costs?

Stamp duty is 5 percent on land, commercial property and resale flats, at every price point. The lower slabs, 2 percent up to 20 lakh and 3 percent from 20 to 45 lakh, apply only to the first sale of a flat by the builder under Article 20(2A) of the Karnataka Stamp Act. Cess and surcharge are added on the duty amount. Registration is 2 percent of value, uncapped, for documents executed on or after 31 August 2025. Everything is charged on the higher of your sale value or the guidance value.

02 Valuation

Why does guidance value matter?

Guidance value is the minimum value the state fixes for an area, what other states call circle rate. It is the floor for stamp duty, so a deal cannot be registered below it, and registering under it can trigger proceedings under Section 45A of the Karnataka Stamp Act. Values are revised annually, normally with effect from 1 April.

03 Title

What does a title check actually cover?

The encumbrance certificate for 30 years, the sale deed chain, the khata and tax receipts, and for land the RTC and mutation entries. The EC records registered documents only, so an unregistered claim or an oral family arrangement will not show in it. That is why the deed chain and, on rural land, the revenue record are read alongside rather than instead.

04 Land use

Was the land ever agricultural?

All land in Karnataka is agricultural by default. Section 95 of the Karnataka Land Revenue Act, 1964 lets the Deputy Commissioner convert it to non-agricultural use, which is why people say DC conversion. Without a valid order there is no khata, no building plan sanction, no bank loan and no legal construction. Orders can be partial, lapsed or conditional, so the order itself gets read, not the word converted.

05 RERA

Does K-RERA apply?

It applies to a promoter's real estate project, apartments or a plotted layout, where the land exceeds 500 square metres or there are more than eight units. It does not apply to a private resale between individuals or a single site sold by its owner, and a project that already held a completion certificate before the Act is outside it. Where it applies, search it before the site visit.

06 NRI rules

What can an NRI buy in Udupi?

Residential and commercial property, freely. No cap on the number of units and no RBI permission needed, as long as payment comes through NRE, NRO or normal banking channels. Agricultural land, plantation property and farmhouses cannot be bought at all, only inherited. A breach makes the purchase void and the penalty can run to three times the transaction value, so what the record says about classification decides it.
