What decides whether a site is really buildable

01 Land use

Is there a valid 95 conversion order?

All land in Karnataka is agricultural by default. Section 95 of the Karnataka Land Revenue Act, 1964 lets the Deputy Commissioner convert it to non-agricultural use, which is why people say DC conversion. Without that order there is no khata, no building plan sanction, no bank loan and no legal construction. Orders can also be partial, lapsed or defective, so we read the actual order rather than trusting the word converted.

02 Records

Do the RTC and khata match the seller?

The RTC is the primary revenue record for land in Karnataka. We check the RTC, the mutation entries, the khata status and the phani updates at the revenue department, and we cross reference at the sub-registrar office. If the person selling is not the person in the record, the deal stops there.

03 Approvals

Is the layout approved, and how wide is the road?

We check BMRDA or BDA approval, the panchayat limit the site falls in, the zoning under the planning authority's master plan, and the actual road width at the site. Road width decides what you can build and what a bank will fund. A pretty layout plan is not an approval.

04 Title

Is the title clean for 30 years?

We read the encumbrance certificate for the last 30 years, the sale deed chain, and any partition or succession history. The EC costs 35 rupees for the first year and 10 rupees for each further year on the state portal, which makes skipping it indefensible. Disputes get flagged before you pay a rupee, not after.

05 Registration

What will stamp duty and registration cost?

Stamp duty is 5 percent on land, commercial property and resale flats, at every price point. The lower slabs, 2 percent up to 20 lakh and 3 percent from 20 to 45 lakh, apply only to the first sale of a flat by the builder under Article 20(2A) of the Karnataka Stamp Act. A site purchase therefore does not get the lower slab. Cess and surcharge are added on top of the duty amount. Registration is 2 percent of value, uncapped, for documents executed on or after 31 August 2025.

06 RERA

Does K-RERA apply to a site?

It can. K-RERA covers a promoter's real estate project, and a plotted layout counts, where the land exceeds 500 square metres or there are more than eight units. So a layout being marketed by a developer should carry a registration number. A single site sold by its owner is not a project and is outside K-RERA, which is why the revenue record and the conversion order carry all the weight on that kind of purchase.

07 NRI rules

Can it be bought from abroad?

Only if the land is already converted. Under FEMA an NRI or OCI can buy residential property freely, but cannot buy agricultural land, plantation property or a farmhouse at all. A breach can cost up to three times the transaction value and the purchase itself is void, so the classification in the record is what matters, not what anyone says at the site.
